The term Subscriber/Member would include any person, whether an individual or a legal entity who has registered to the Services of asmproprewards (on free basis only), and to whom the access to asmproprewards is restricted by the use of a sign in user name and a password. The user name and password are either allotted by asmproprewards or chosen by the Subscriber or agreed upon by asmproprewards. It is made abundantly clear that only the authorized User has the right to access the Services so offered by asmproprewards.com
The term Member/Visitor will mean and include a person who utilizes any of the Services offered by asmproprewards, without the need or a requirement to create an account i.e. visits non-restricted portions of asmproprewards.com.
The use and access to asmproprewards.com shall be subject to these terms and conditions and community guidelines. For the purposes of this Agreement, any person who does not have a legal or a contractual right to access the Services, but does so, will fall within the definition of an 'unauthorized user' and will nevertheless be subject to the terms and conditions regulating the usage of asmproprewards.com, and expressly so with respect to respecting the intellectual property rights of the ASM, and abiding by terms and conditions below mentioned.
The terms Member and User would include both the Subscriber/Purchaser and Browser/Visitor(s).
The terms 'Service' or 'Services' would mean to include the interactive online information service offered by asmproprewards.com on the internet through which the user may access information carried by asmproprewards.com in the database maintained by it. The terms would also include to mean the search tools through which the User can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. The term would also include services by way of space used by customers for advertisements such as listings and banners. Users then select one or more of the items presented to view the full document/ record. The term Service does not extend to asmproprewards.com acting as an agent either express or implied on behalf of any User/Customer and is merely acting as a medium of information exchange.

Submission and administration of listings/advertisements

Users, who are buying through asmproprewards, must verify details the property/properties as well as its right, title, ownership, lien etc. on their own. The ‘verified’ tag visible on property/properties on asmproprewards merely indicates the verification of the existence of the property in the manner it has been advertised. At no point shall the ‘verified’ tag be construed to be a verification of any documentation, ownership details, area or pricing details of the property/properties.

Content

We employ proprietary and third-party AI tools to identify and address harmful content on our platform. These tools are designed to take reasonable efforts towards detecting violations of platform terms and applicable laws, including harmful behaviour such as speech that violates our platform terms. Automated moderation may operate automatically or with human oversight, depending on the complexity of the content and internal guidelines. Based on the output of technological moderation, content may be approved, rejected, or escalated to a second level of review by human moderators. These tools rely on third-party services to provide the detection and moderation capabilities. Our automated tools function as part of a multi-layered moderation process. Please note that users have the right to raise grievances or appeal moderation decisions in accordance with our platform terms [ Grievances ] and such feedback will be reviewed in accordance with established timelines, including by human moderators where necessary. These tools are part of our ongoing efforts to improve moderation capabilities and ensure compliance with legal and platform standards. While we endeavour to maintain accuracy and fairness, no system is perfect. The measures are implemented on an “as is” basis, and we will continue to refine them in collaboration with external service providers to better protect our community.

Reward Terms

Rewards for the loyalty offered by ASM are only as per the terms of generation and receiving/winning and shall have no guarantee to any Member. There is no payment for any reward/service/use/or any other mentioned on asmproprewards.com by any member registered by ASM. ASM offers no guarantees whatsoever for the rewards mentioned and to be given to winners until and unless held or generated as per terms and conditions of every reward.

Refund of any purchase from Merchant/s

Though ASM payment reconciliation team works on a 24 x 7 basis, ASM offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Subscribers card/bank accounts. This is on account of the multiplicity of organizations involved in processing of online transactions, the problems with Internet infrastructure currently available and working days/holidays of financial institutions. Refunds in the event of wrong/objectionable property content being posted on the site would be at the discretion of ASM. If you utilize asmproprewards in a manner inconsistent with these terms and conditions, ASM may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.

Use of Information

User agrees to treat all information obtained from the Service, including listings, member directory, and any information otherwise made available to User in the Service ("Content") as proprietary to asmproprewards. User agrees that Content reserved for members will be maintained as confidential and shall be protected as a trade secret of asmproprewards. ASM does not ensure the accuracy of, endorse or recommend any Content and a User uses such Content at the User's own risk. A User may access the listings/advertisements in the Service solely to obtain initial information from which further evaluation and investigation may commence. User shall limit access to and use of listings to personal and internal use, and shall not use listings obtained from the Service for further distribution, publication, public display, or preparation of derivative works or facilitate any of these activities in any way. User shall not use or reproduce any Content that is obtained from the Service, or that is otherwise made available to User in the Service, for or in connection with any other listing/advertising Service or device. User further shall not use the Service provided by the company in any other manner for or in connection with any other listing Service or device. Users violating these specific terms, specifically those Users searching the Service in an abusive or excessive manner, by automated or manual means, shall be subject to immediate termination of their membership without notice.

Intellectual property rights

All logos, brands, trade marks and Service marks ("Marks") appearing in asmproprewards.com are the properties either owned or used under license by ASM and / or its associates. All rights accruing from the same, statutory or otherwise, wholly vest with ASM / its associates. The access to asmproprewards.com does not confer upon the User any license or right to use in respect of these Marks and therefore the use of these Marks in any form or manner, whatsoever is strictly prohibited. Any violation of the above would constitute an offence under the prevailing laws of India. ASM respects the Intellectual Property Rights of all, it has and will continue to adhere to all the laws applicable in India in this respect. ASM shall protect and respect the Intellectual Property Rights of the users as well as third parties to the best of its ability. In a case where a User(s) are found to be using asmproprewards.com as a platform to infringe the Intellectual Property Rights of others, ASM will be free to terminate this Agreement forthwith without any notice to the user. By allowing Users to access asmproprewards.com, ASM grants the Users a limited, non-exclusive, non-assignable, revocable license (the "License") to access and use the Services, provided that the User is in compliance with the terms and conditions of the Agreement.

Restrictions/Prohibitions

The following actions will inter alia constitute a misuse of asmproprewards.com and are strictly prohibited:

• Utilising the Services offered by asmproprewards.com in any manner so as to impair the interests and functioning of ASM/asmproprewards and which is non-compliant with laws and regulations including RERDA.
• Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivative works from or otherwise exploiting any content, data or information including profiles, personal details, photographs and/or graphics available on asmproprewards.com and/or any services or products of the ASM in any manner or for any purpose which is not consistent with or in accordance with the Terms of Use.
• Users are expressly prohibited from using or exploiting asmproprewards and/or any content or data provided therein for:
  • Any commercial purposes such as creating alternate databases or extending access to asmproprewards.com to third parties without prior written consent of the ASM
  • Undertaking any business activity which is in competition with the business of ASM
  • Sharing access with persons who are not contracted with the ASM
  • Reselling the products or services promoted by the ASM
• Using or attempting to use any automated program software or system or any similar or equivalent process including spiders robots or crawlers to access navigate search copy monitor download scrape crawl or otherwise extract in any manner any data or content including but not limited to adding or downloading profiles contact details or sending or redirecting messages from asmproprewards.com.
• Gaining or attempting to gain unauthorized access by hacking password mining or any other means to:
  • Any portion or feature of asmproprewards.com or any services or products not intended for you
  • Any server website program or computer systems of ASM or any third parties or users
• Modifying the services provided through asmproprewards.com or their appearance using any technology or overlaying any additional offering on top of such services or simulating asmproprewards services or functions without explicit written consent obtained by approaching product@asmproprewards.com.
• Accessing asmproprewards through interfaces other than those expressly provided by ASM.
• Attempting to breach or breaching any security or authentication measures set up by ASM including probing scanning or testing system or network vulnerabilities.
• Scraping downloading including bulk downloading replicating or otherwise extracting any information or data from asmproprewards.com by any automatic or manual process to offer products or services similar to or competing with ASM.
• Reverse engineering decompiling disassembling deciphering or attempting to derive the source code for the site application or related technology.
• Circumventing or attempting to circumvent technological protections employed by ASM or third parties including bypassing service limits such as search limits captcha limits or trigger-based restrictions.
• Interfering with or disrupting or attempting to interfere with or disrupt the use of asmproprewards or any computer networks connected to it by any user.
• Developing using or attempting to use automated programs scripts robots third-party software browser extensions add-ons iframes mirroring or HTML parsers to access extract modify or scrape data from asmproprewards without explicit written consent obtained by approaching legal@asmproprewards.com.
• Impersonating any person or entity or misrepresenting employment or affiliation with any person or entity.

• Stalking threatening or harassing any other user.

• Engaging in framing mirroring simulating appearance or deep linking into asmproprewards without prior permission of ASM.
• Spamming ASM or other users through unsolicited bulk email SMS or other electronic communication.
• Hosting uploading posting transmitting publishing or distributing any material or information that:
  • Violates applicable local state national or international laws or regulations
  • Belongs to another person without rights
  • Infringes intellectual property or proprietary rights of ASM or third parties
  • Contains viruses or malicious code
  • Is harmful abusive defamatory obscene pornographic paedophilic hateful or discriminatory
  • Encourages money laundering gambling or criminal activity
  • Deceives or misleads recipients or spreads misinformation
  • Harms minors
  • Threatens the unity integrity security sovereignty or public order of India or friendly relations with foreign states
• You expressly agree not to copy distribute modify reuse or reproduce any information text graphics or material from asmproprewards on any other server system or publication for commercial gain without consent.
• You shall not remove copyright trademark or other intellectual property notices from any copied or printed material or link to asmproprewards without express written consent.
• Violations of system or network security may result in civil or criminal liability.

Asmproprewards.com is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.

ASM shall not be responsible for any problem or technical malfunction on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problem or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to any User and/or Members or to any other person's computer related to or resulting from participating or downloading materials/information from the website.

For the purposes of the Consumer Protection Act, 2019 (CPA), the term Consumer will be limited to Customers who have not subscribed to asmproprewards.com for purposes of commercial gain (business purposes) and their intent to utilize the services for individual use only.

Unless otherwise specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of ASM (service provider) is to provide access of its on-line portal to the customer for the duration of the this program period & reference to any usage, by whatever name called or any other performance obligation, if any, is to provide the upper limit for consumption, which by itself, does not create any additional performance obligation upon ASM.

ASM will not be liable on account of any inaccuracy of information on this web site. Any breach of privacy or of the information provided by the consumer to ASM to be placed on the website by technical or any other means is not the responsibility of ASM and ASM does not guarantee confidentiality of information provided to it by any person acquiring/using all/any information displayed on asmproprewards.com website or any of its other websites / domains owned and operated by ASM.

Termination

ASM may, without notice in its sole discretion, and at any time, terminate or restrict your use or access to asmproprewards (or any part thereof) for any reason, including, without limitation, that ASM based on its judgement and perception believes you have violated or acted inconsistently with the letter or spirit of these terms and conditions or any applicable law.

Indemnification

ASM will not be party to any legal proceedings between parties contracted through these Services. In case ASM is sought to implicated in any legal proceedings, costs will be recovered from the party that names ASM as a party to such proceedings. ASM shall abide with any court order served on it through due process.
